Yates Desygn, and its current and future affiliates (together, “Yates Desygn, “We,” “Us,” “Our”) takes the security and privacy of your personal information very seriously. This Privacy (“Notice”) describes how we process personal information about you that we collect through the website or application operated and controlled by us from which you are accessing this Notice (the “Site”). This Notice does not apply to information that we collect offline, such over the telephone, in person, or by facsimile. By using the Site, you agree to the terms and conditions of this Notice.

This Notice is considered part of our Terms and Conditions.

1. Personal Information We Collect

1.1 “Personal Information” is information that identifies you as an individual, such as: name, postal address, telephone number, and email address.

1.2. We may collect and process the following Personal Information about you:

1.1.4. Some areas of this Site may allow you to submit information related to job opportunities with Yates Desygn, in which case we collect the information that you submit to us to be considered for employment opportunities.

Generally, this information is collected through what we refer to herein as “Traffic Data.” We may collect and store such Traffic Data automatically whenever you interact with the Site. We may also collect information regarding customer traffic patterns and site usage. This Traffic Data is used to analyze and improve the Site, to deliver offers to you on the Site that may be of interest to you, and to improve your experience on the Site. 2. How We Use Personal Information

2.1. We use Personal Information about you in the following ways:

2.1.2. To ensure that content from the Site is presented in the most effective manner for you and for your computer.

2.1.7. Where you submit information through the careers link on our Site, we use such information to consider you for employment opportunities.

3. Disclosure of Your Personal Information

3.1. We may disclose your Personal Information to our affiliates, who will use it in accordance with this Notice.

3.2. We may disclose your Personal Information to third parties:

3.2.1. Who are service providers that perform functions on our behalf. Examples include providing customer service, sending postal mail and e-mail, and analyzing data. These service providers have access to Personal Information needed to perform their functions but are contractually prohibited from using it for other purposes.

3.2.2. In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceeding).

3.2.3. If we are under a duty to disclose or share your Personal Information in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Yates Desygn or any affiliate, our customers, or others. 4. Your Rights and Choices

4.1. Opt Out From Direct Electronic Communications: Where it is in accordance with your preferences, Yates Desygn may send you direct electronic communications through email. You may “opt out” of receiving these electronic communications by following the instructions in the message that you receive, or by sending an e-mail to hello@yatesdesygn.com indicating which communications you no longer wish to receive. Note that we may still send certain administrative messages to you by email that relate to your use of the Site or transactions in which you have engaged with Yates Desygn.

4.2. Opt Out From Cookie-Related Processing: You can opt out from certain cookie-related processing as described in Sections 5 of this Notice.


5. Passive Information Collection, Use, and Choices

5.1. As you navigate the Site certain Traffic Data may be passively collected, meaning it is gathered without your actively providing it. This is done using the following technologies in the following ways:

5.1.1. IP Addresses: An IP address is a unique identifier that certain electronic devices use to identify and communicate with each other on the Internet. When you visit our Site, we may view the IP address of the device you use to connect to the Internet. We use this information to determine the general physical location of the device and understand from what geographic regions our website visitors come. We also may use this information to enhance our Site.

5.1.2. Through Your Browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type and operating system type and version screen resolution, and Internet browser type and version. Just as IP addresses, we may use this information to enhance our Site and user experience.

5.1.3. Using Monitoring Tools: The Site may utilize pixel tags, web beacons, clear GIFs, Flash Shared Objects, HTML5 Local Storage, HTML5 Mini Databases, and other similar technologies, both on certain aspects of the Site and in HTML-formatted e-mail messages to you. These monitoring tools are used for the purpose of, among other things, measuring the success of our marketing campaigns, compiling statistics about Site usage and response rates, and tracking the activities of users of the Site and e-mail recipients.

5.1.4. Cookies: Like many companies, our Site may use “cookies” to help make sure the Site is meeting the needs of its users and to help us make improvements. Cookies are bits of text that are placed on your computer’s hard drive when you visit certain websites. We may use cookies set by us on the Site to tell us, for example, whether you have visited us before or if you are a new visitor. We use third-party cookies set by our service providers to collect information about how visitors use the Site, including how long you spend on each page, and how you got to the Site. The main cookies used by our Site are created from Squarespace Analytics, which track your IP address.

At any point in time, you can change your internet browser settings to prevent the use of cookies. Each browser has a different procedure for disabling the use of cookies. Alternatively, you may visit http://www.aboutcookies.org where you can review information on how to control cookies on a variety of browsers. You will also find details of how to delete cookies from your computer and other general information about cookies. If you use your browser settings to block all types of cookies, however, you may not be able to access all or parts of our Site or functionality may be limited.

We do not track your behavior across third party websites. Our Site currently does not respond to “Do Not Track” (DNT) signals and we operate as described in this Privacy Statement whether or not a DNT signal is received, as there is no consistent industry-standard for compliance.


6. Social Media

6.1. Some aspects of the Site may allow you to interface with other websites, social media, and other online services, such as Facebook, Instagram, and Houzz. We will diligently work to identify these aspects of the Site to you, for example, by identifying them with the applicable third-party logos or trade names. These interfaces may allow the social media or other service to automatically collect information about you, such as browser information and IP address. If you interface with the Site through your social media account, we may contact you or enable you to share your experience and content via your social media account, which information may be publicly viewed by other users of those services. 7.1. The Site is not intended for persons under the age of 18. We do not knowingly collect Personal Information online from persons in this age group. We reserve the right to delete any information identified as having been provided by such persons at our discretion.
